By participating in any sweepstakes, giveaway, or promotional contest (“Promotion”) sponsored by ProMD Health or ProMD Health Tox Bar (“Sponsor”), you agree to the following Terms & Conditions.
1. Eligibility
Promotions are open to legal residents of the United States who are at least 18 years old at the time of entry, unless otherwise specified in the Promotion details.
Employees of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members are not eligible to participate.
Void where prohibited by law.
2. Promotion Period
Each Promotion will begin and end on the dates specified in the official announcement (the “Promotion Period”). Entries received outside of the Promotion Period will not be eligible.
3. How to Enter
Entry instructions will be provided in the specific Promotion announcement.
Unless otherwise stated:
- No purchase is required to enter.
- Limit one entry per person unless otherwise specified.
- Automated entries or fraudulent submissions are prohibited.
Sponsor reserves the right to disqualify any entrant who violates these Terms & Conditions or tampers with the entry process.
4. Winner Selection & Notification
Winners will be selected at random (unless otherwise specified in the Promotion details) from all eligible entries received during the Promotion Period.
Winners will be notified via the contact method used to enter (email, social media message, etc.). If a winner does not respond within 48 hours, Sponsor reserves the right to select an alternate winner.
Sponsor is not responsible for failed delivery of notifications due to spam filters, incorrect contact information, or technical issues.
5. Prizes
Prize details, approximate retail value (ARV), and any restrictions will be disclosed in the Promotion announcement.
Prizes:
- Are non-transferable.
- May not be redeemed for cash.
- May not be substituted except at Sponsor’s discretion.
- Are subject to availability.
Sponsor reserves the right to substitute a prize of equal or greater value if necessary.
All federal, state, and local taxes associated with prize acceptance are the sole responsibility of the winner.
6. Publicity Release
By accepting a prize, winners grant Sponsor permission to use their name, likeness, city/state, testimonial, and/or photograph for promotional purposes without additional compensation, unless prohibited by law.
7. Release of Liability
By participating, entrants agree to release and hold harmless Sponsor and its affiliates, employees, and representatives from any liability, loss, injury, or damage arising from participation in the Promotion or acceptance, use, or misuse of any prize.
Sponsor is not responsible for:
- Technical malfunctions
- Lost, late, incomplete, or misdirected entries
- Unauthorized intervention
- Printing or typographical errors
8. General Conditions
Sponsor reserves the right to:
- Cancel, suspend, or modify the Promotion if fraud, technical failures, or other factors impair its integrity.
- Disqualify any individual found to be tampering with the entry process.
All decisions by Sponsor are final.
9. Privacy
Information submitted with an entry is subject to Sponsor’s Privacy Policy. By entering, you agree to receive marketing communications from Sponsor. You may unsubscribe at any time.
10. Platform Disclaimer (If Applicable)
If the Promotion is hosted on or promoted through social media platforms (including but not limited to Instagram, Facebook, TikTok, etc.):
This Promotion is in no way sponsored, endorsed, administered by, or associated with the platform. By participating, you release the platform from any responsibility related to this Promotion.
11. Governing Law
All Promotions are governed by the laws of the State of Maryland, without regard to conflict of law principles.
